Court Adjourns Case, As Civil Society Organization Seeks To Declare Lawmakers Seat Vacant

Court adjourned  case  filed by the civil society organization seeking to declare the seats of Martins Amaewhule and 26 other lawmakers vacant to 21 August .

The case filed by a coalition of Rivers based Civil Society Organizations seeking to declare the seats of Martin Amaewhule and 26 other lawmakers vacant following their defection from the Peoples’ Democratic Party to the All Progressives Congress came up for hearing at the Federal High Court, Port Harcourt.

At the last sitting over the case there were applications for joinder by the APC and the PDP, there was however some mild drama with 2 Senior Advocates announcing appearances for the PDP. The presiding judge, Mohammed Obile however urged both counsels to harmonize their representation.

During today’s hearing however, the issue of representation continued with the party’s national legal adviser Kamaldeen Ajibade SAN contending that there’s only one PDP and that he has the sole authority to prosecute on the party’s behalf. This was however challenged by the lawyer sent from the state Joshua Musa SAN.

Speaking to journalists afterwards, the PDP National Legal Adviser insisted that there is only one PDP and that he is in charge of prosecuting cases for the party. He further reiterated the party’s position that Amaewhule and 26 lawmakers from the Rivers state House of Assembly are no longer members of the PDP.

After taking arguments the judge adjourned the matter to 21st August for ruling.
